How to file an EMPLOYMENT Charge of Discrimination

 
Step 1   Write your name, home telephone number, and complete address on the Charge.

Step 2  

In the area marked “Company,” write the name of your employer, their telephone number, their complete address, and the number of people they employ.

NOTE
Be sure to write down the Ohio county in which the employer is located

Step 3   Place an “X” next to the type(s) of discrimination that happened to you.

Step 4   State the latest date that the discrimination happened.

IMPORTANT FACT
In Employment cases, the OCRC has jurisdiction over events that happened within the previous 6 months, and the EEOC has jurisdiction over events that happened within the previous 300 days

Step 5   Write a brief description of what happened to you.

In your description of the facts, be sure to include the following information:

5a Explain the basis on which you allege that you were discriminated against.

This can be your:

race (e.g., African-American, Caucasian, Asian, etc.).

color (e.g., black, white, light-skinned, dark-skinned, etc.).

religion (e.g., Jewish, Muslim, Christian, etc.).

sex ((e.g., male, female, pregnancy, sexual harassment, sexual stereotyping, etc.).

national origin (e.g., you were born in China, Mexico, etc.).

age (i.e., exact date of birth, must be at least 40 years old).

ancestry (e.g., your ancestors were born in China, Mexico, etc.).

disability (having a physical or mental impairment that substantially limits your ability to care for yourself, perform manual tasks, walk, see, hear, speak, breathe, learn, or other major life activity; or having a record of a physical or mental impairment, or being regarded as having a physical or mental impairment).

HELPFUL TIP
When alleging disability discrimination, be sure to describe your condition in detail, and explain how it limits you at home, at work, or any other way it restricts you in your daily life. Give detailed examples.

5bState the date of your hire and the most recent position you have held.

5cState each alleged “discriminatory act” that happened to you within the last year (e.g., termination, suspension, demotion, failure to interview, failure to hire, denied accommodations for disability or religion, etc.).

5dState the date of each discriminatory act.

5eState the name of the person who made the decision to implement each discriminatory act.

5fIf a reason was given to you for the discriminatory act, state that reason.

5g State how you are qualified for the job.

5hState all facts that show illegal discrimination was the real reason for each act. This can be comments, documents, statistics, or any other facts.

5iState all facts that show that the reasons given by the employer are not the real reasons. This can be comments, documents, statistics, or any other facts.

Thank you for using the Ohio Civil Rights Commission's services. An investigator will be contacting you in the near future to discuss the allegations in your Charge. It will be necessary for you to sign the charge in the presence of the investigator or before a notary and return it to the investigator within ten days. Failure to sign the charge under oath will ultimately result in the Commission dismissing your charge.

BY FILING WITH THE OHIO CIVIL RIGHTS COMMISSION YOU ARE AUTOMATICALLY FILED WITH THE EEOC IF YOUR EMPLOYER HAS 15 OR MORE EMPLOYEES.
